Overview
Specifies that major amendments to the general plan of a municipality must be presented within a certain time period of when the proposal is made.
History
The general plan of a municipality and any amendment to such must be adopted or readopted according to the provisions outlined in statute. The adoption or readoption of a general plan or an amendment must be by resolution of the governing body of the municipality and must be approved by affirmative vote of at least two-thirds of the members of the governing body. All major amendments to the general plan that is proposed for adoption by the governing body must be presented at a single public hearing during the calendar year when the proposal is made (A.R.S. § 9-461.06).
Provisions
1. Stipulates that all major amendments to a general plan proposed for adoption by the governing body of a municipality must be presented at a public hearing within 12 months of when the proposal is made. (Sec. 1)
2. Includes adopting or amending an open space element or land use element or growth element of a general plan. (Sec. 1)
3. Adds that a municipality must not diminish the existing private property rights unless the municipality receives the written consent of the landowner or provides an alternative, economically viable designation in the general plan or zoning ordinance to protect such existing property rights. (Sec. 1)
4. Removes the minimum one residential dwelling per acre requirement relating to the application of an element of a general plan. (Sec. 1)
